The Accra High Court has remanded in police custody a driver who forced a woman to perform oral sex on her after robbing her of her mobile phone and GHS400.
Francis Dow Kudjawu, who is being held on charges of robbery and indecent assault, has pleaded not guilty.
The court, presided over by Justice Mrs Mary Mame Eku Nyanzuh, was told by the prosecution that Kudjavu let his victim off the hook after ejaculation.
It was then that Kudjavu attempted to have anal sex with the complainant, but could not penetrate.
Kudjavu is expected to appear before the court again on April 4.
The prosecution has been ordered to record its disclosure, while the accused person is also to file an excuse to substantiate his claim that he was not present at the spot on the day of the incident.
The court will however order the police to investigate the whereabouts of the accused person.
The case of the State is that the complainant (name not given) resides at Tema.
The prosecution said that the accused person is also a resident of the same locality.
It said that on March 29, 2020, the complainant went to meet her parents in Sakumono and returned home at around 9:45 pm.
The prosecution stated that when the complainant opened the gate of her house, she got into her car and closed the gate.
It said that when the complainant returned to her car to switch off the engine, she saw the accused, “who was in a hooded sweatshirt, scaling the fence wall in the complainant’s premises.
The accused, armed with a kitchen knife, ordered him (complainant) to come out of the car. The accused dragged the complainant from the car. The victim kept shouting for help, but no one came to her aid.
The prosecution said that the accused dragged the complainant out of the car and ordered him to kneel down and tore his clothes at knife point.
It said that the accused attempted to have anal sex with the complainant, but could not penetrate even after several attempts.
Therefore, the accused ordered the complainant to perform oral sex on him till she ejaculates on the floor.
The prosecution said at knife point, Kudjavu took the complainant’s Huawei P30 phone worth GHS1,500 and GHS400 in cash.
The complainant reported the matter to the nearest Domestic Violence and Victim Support Unit.
On May 12, 2020, it stated that Kudjavu was arrested for a similar offense and during an identification parade, the complainant caught hold of him.
